1. Acceptance of Terms

By accessing or using Faraday (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Faraday is an AI-powered influencer discovery and campaign management platform that helps users identify relevant Twitter/X creators, analyse their audience quality, and manage outreach campaigns. The Service uses publicly available data from Twitter/X and third-party data providers to surface influencer profiles and engagement metrics.

3. Eligibility

You must be at least 18 years of age and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

4. User Accounts

Access to the Service requires authentication via a supported OAuth provider. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account. We reserve the right to terminate accounts that violate these Terms.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation, including Twitter/X's Terms of Service.
  • Harvest, scrape, or collect personal data about individuals without their consent in a manner that violates applicable privacy laws.
  • Send unsolicited commercial messages (spam) to influencers or other users.
  • Engage in deceptive, fraudulent, or misleading practices.
  • Attempt to gain unauthorised access to any part of the Service or its related systems.
  • Reverse-engineer, decompile, or disassemble any portion of the Service.
  • Use the Service in any way that could damage, disable, or impair the Service or interfere with other users.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Faraday and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Faraday. You retain ownership of any content you submit to the Service, but grant Faraday a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display such content solely for the purpose of operating and improving the Service.

7. Third-Party Data and APIs

The Service integrates with third-party platforms including Twitter/X and data providers. Your use of the Service is subject to the terms and policies of those third-party platforms. Faraday is not responsible for the accuracy, completeness, or availability of third-party data. Influencer profile data, follower counts, and engagement metrics are sourced from public APIs and may not always reflect real-time information.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Faraday does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. You use the Service at your own risk.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Faraday shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if Faraday has been advised of the possibility of such damages. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve months preceding the claim.

10. Modifications to the Service and Terms

We reserve the right to modify or discontinue the Service at any time without notice. We may also revise these Terms from time to time. If we make material changes, we will provide notice by updating the effective date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in a court of competent jurisdiction, as mutually agreed upon by the parties.
